Consent and release for use of images and videos (sessions)
This section summarises the grant of rights when you book a session with Nimadi Pet Photography (“Nimadi”, “we”, “us”) and complete our online consent form or sign a separate release. It is written to be clear and practical; it works together with our Privacy Policy and any contract for your package.
You grant Nimadi the right to use visual and audio content from your session — including photographs, video, and your image, likeness, and voice if recorded — for public promotion of our services, as you authorise. Nimadi may edit, crop, colour-grade, combine with other materials, and use or license others to use that content in media and formats reasonably needed for our work (website, portfolio, social channels, print or digital promotion, and similar), only within the scopes you authorise.
You understand that images may be edited for style and consistency. Unless we agree otherwise in writing, you do not need to approve every final crop before we use content for the purposes you have authorised.
For the uses you tick in the consent form (or agree in writing), you waive any right to additional fees or royalties beyond what is already included in your booking or separate agreement.
To the fullest extent permitted by Portuguese and EU law, you release Nimadi, our contractors, and licensees from claims and demands connected with use of the materials in accordance with your consent — without prejudice to rights that cannot legally be waived (for example mandatory consumer or personality rights where they apply).
You agree that authorised content may appear on the internet, including social networks, and in marketing, in Portugal and internationally, as your choices allow. Captions, tags, or short context may appear alongside images or video.
Copyright in the photographic and video works produced by Nimadi remains with Nimadi unless your contract states otherwise. You receive the usage permissions you grant here plus any delivery and licence terms in your session agreement or gallery terms.
You warrant that you are 18 or older, or that a parent or legal guardian authorises this on your behalf, and that you have authority to consent for any recognisable people in the content (or that only pets are recognisable and you are the owner or authorised to consent). Where the law allows, this release benefits Nimadi and our successors and assigns.
You may withdraw or limit consent for future processing where the law allows; uses already made in good faith under your prior consent may continue where permitted. If anything in this section conflicts with a signed contract for your session, the contract prevails for that booking.
No warranty
The site is provided “as is”. We strive for accuracy but do not guarantee uninterrupted access or error-free content.
Limitation of liability
To the extent permitted by applicable law, Nimadi is not liable for indirect or consequential loss arising from use of the website.
Law
These terms are governed by the laws of Portugal. Courts of Portugal have jurisdiction, without prejudice to mandatory consumer rights.
